Agreement to Terms

These Terms of Service (“Terms”) govern your use of Furthr, a hiking-log app developed by Ian Sacco (“we,” “us,” or “our”). By creating an account or using Furthr, you agree to these Terms. If you do not agree, do not use the app.

This agreement is between you and Ian Sacco only, not with Apple Inc. or Google LLC. Apple and Google are not parties to these Terms and are not responsible for Furthr or its content.

License to Use the App

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use Furthr on devices you own or control, solely for your personal, non-commercial use, in accordance with these Terms and Apple's App Store Terms of Service.

You may not copy, modify, distribute, sell, or lease any part of the app, nor may you reverse-engineer or attempt to extract the source code.

Your Account

You must be at least 13 years old to create an account. By creating an account you represent that you meet this requirement.

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us at hikefurthr@gmail.com immediately if you believe your account has been compromised.

We may suspend or terminate your account if we reasonably believe you have violated these Terms.

User Content

You retain ownership of the content you create in Furthr — your hike logs, notes, photos, videos, messages, group posts, and profile information ("User Content").

By submitting User Content, you grant us a limited license to store, display, and deliver that content to you and, where you have chosen to share it, to your friends and the groups you participate in within the app. We do not use your User Content for advertising or sell it to third parties.

You are solely responsible for your User Content. Do not post content that is unlawful, harassing, defamatory, obscene, or that infringes the intellectual property rights of others.

If you send us feedback, ideas, or suggestions about Furthr, you grant us the right to use them without restriction or compensation.

Content Moderation and Reporting

Furthr has no tolerance for objectionable content or abusive behavior. Content that is unlawful, pornographic, harassing, threatening, hateful, or otherwise objectionable may be removed at any time, and the accounts responsible may be restricted, suspended, or permanently banned.

The app provides tools to report users, messages, and posts, and to block other users. We review reports promptly — normally within 24 hours — and will remove content that violates these Terms and take action against the accounts responsible.

We may remove any User Content or suspend any account at our reasonable discretion where we believe it is necessary to protect the service or its users.

Safety and Outdoor Activity Disclaimer

Furthr is a hiking-log and mileage-tracking tool. It is not a substitute for proper navigation equipment, wilderness training, or sound judgment in the outdoors.

GPS tracking accuracy varies by device, terrain, and environmental conditions. Do not rely solely on Furthr for navigation or route-finding in remote areas. Always carry a map, compass, or dedicated GPS device when venturing into the backcountry.

Trail information in Furthr — including trail routes, distances, elevation data, and automated trail suggestions — is assembled from third-party sources such as OpenStreetMap contributors and is provided for planning purposes only. It may be incomplete, inaccurate, or out of date, and trails may be closed, rerouted, hazardous, or cross private land without that being reflected in the app. A trail appearing in Furthr is not an endorsement that it is open, legal, or safe to hike. Check current conditions, closures, and access rules with local land managers before you go. Weather shown in Furthr comes from a third-party provider and may not reflect actual conditions.

Outdoor activities involve inherent risks including injury, illness, and death. You assume full responsibility for your safety and the safety of anyone in your party. We are not liable for any injury, loss, or harm arising from your use of the app or your participation in outdoor activities.

Prohibited Uses

You agree not to use Furthr to: (a) violate any applicable law or regulation; (b) impersonate another person or misrepresent your affiliation with any person or entity; (c) transmit spam, malware, or other harmful code; (d) scrape, crawl, or systematically extract data from the service; (e) interfere with or disrupt the integrity or performance of the service; or (f) attempt to gain unauthorized access to any part of the service.

Intellectual Property

The Furthr name, logo, app design, and original content (excluding your User Content) are the property of Ian Sacco and are protected by copyright, trademark, and other applicable laws.

If you believe any content in the app infringes your intellectual property rights, please contact us at hikefurthr@gmail.com with sufficient detail for us to investigate.

Maintenance, Support, and Updates

We are solely responsible for providing maintenance and support for Furthr. Apple Inc. has no obligation to furnish any maintenance or support services with respect to Furthr.

We may update the app from time to time to add features, fix bugs, or address security issues. Continued use of the app after an update constitutes acceptance of any updated Terms.

Disclaimer of Warranties

Furthr is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the app will be uninterrupted, error-free, or that any defects will be corrected. You use Furthr at your own risk.

Limitation of Liability

To the fullest extent permitted by applicable law, Ian Sacco will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of Furthr, even if we have been advised of the possibility of such damages.

Our total liability to you for any claims arising under these Terms will not exceed the amount you paid us in the twelve months prior to the claim, or $10 USD if you have not made any payments.

Third-Party Claims

In the event of any third-party claim that Furthr or your possession and use of the app infringes that third party's intellectual property rights, Ian Sacco, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

App Store and Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a United States Government embargo or that has been designated by the U.S. Government as a “terrorist supporting” country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

As between Ian Sacco and Apple, Ian Sacco — not Apple — is responsible for addressing any claims by you or any third party relating to Furthr or your possession and use of it, including product liability claims, claims that Furthr fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation.

You acknowledge and agree that Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

Maps & Data Attributions

Furthr's maps and trail data are built on open and licensed data sources: map tiles and styles © MapTiler and © OpenStreetMap contributors (trail and boundary data from OpenStreetMap is available under the Open Database License, opendatacommons.org); mountain-range boundaries from the GMBA Mountain Inventory v2 (Snethlage et al. 2022, earthenv.org/mountains), licensed under CC BY 4.0; country outlines, shaded-relief and land-cover rasters from Natural Earth (naturalearthdata.com, public domain); ocean depth from the GEBCO 2024 Grid (GEBCO Compilation Group, gebco.net); satellite imagery © MapTiler and NASA Blue Marble; terrain elevation from the Mapzen Terrain Tiles hosted on AWS Open Data. The map engine includes code ported from MapLibre GL JS and MapLibre Native (BSD licenses); the full notices are in the app under Settings → Credits.

Governing Law

These Terms are governed by the laws of the State of New Hampshire, United States, without regard to its conflict of law principles. Any dispute arising from these Terms will be resolved in the courts of New Hampshire.

Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date above. Material changes will be communicated in the app or by email. Continued use of Furthr after changes take effect constitutes your acceptance of the updated Terms.
